The Office of the Attorney-General and the Ministry of Justice has in official responses to a Right to Information (RTI) request, debunked and exposed as untrue allegations made by the Minister for Government Communications, Felix Ofosu Kwakye, against former Attorney-General and Minister for Justice, Mr Godfred Yeboah Dame, on an Accra-based television station, Metro TV’s programme “Good Morning Ghana”.

Appearing on the widely watched television programme on Friday, 10 October 2025, as a panelist with host of Metro TV’s Good Evening Ghana” programme, Paul Adom-Otchere, Felix Ofosu Kwakye categorically asserted that Mr Dame had deliberately ignored a report confirming illegal mining activities allegedly perpetrated by Akonta Mining Company Limited, a company owned by Ashanti Regional Chairman of the NPP, Bernard Antwi Bosiako (Wontumi) presented to the former Attorney-General by the Criminal Investigations Department (CID) of the Ghana Police Service, whilst he was in office.

“President Akufo-Addo was not willing to punish anybody for anything that he did under his government. They engaged in illegal mining. The CID investigates, and then you come on national television and say that the person who has been fingered in that CID report is innocent, and did nothing … he knew It… If he didn’t know, then he did not deserve to be in the position.

“The Attorney-General of the day (Godfred Dame) cannot claim that he didn’t know about the report. What they are saying by this, then, is that they didn’t investigate the claims against Akonta mining, which is even worse,” Felix Ofosu Kwakye said in the interview.

Alarmed by the wild allegations of Felix Ofosu-Kwakye, the co-panelist, on the programme, Mr Paul Adom-Otchere stated that he had checked with the former Attorney-General, Godfred Dame, who had said that no such report was presented to him in his tenure as Attorney-General.

“Maybe you should call the Attorney-General and ask him … that the government minister says you are aware of the report. He says I am not aware of the report”. Paul Adom-Otchere said.

However, motivated by what he claimed was factual record he had, Mr Felix Ofosu-Kwakye stated that “Paul, what you are saying has grave implications for the competence of Godfred Dame as Attorney-General. What you are saying is that … I am saying that there was a CID report done in 2022 and given to the Government which they did not act on.

“I am saying that the Attorney-General and the Government are aware. The implication of what you are saying is that he (Dame) was not fit for the job and by inaction he was complicit in galamsey by inaction.”

Ofosu-Kwakye proceeded to make other serious allegations against the former Attorney-General insinuating that he was complicit in galamsey and that by virtue of that, he was not fit to hold the office of Attorney-General and Minister for Justice.

However, shortly after the television programme, a private legal practitioner, Mr. Jonathan Asare, with a reputation for conducting investigations into public interest legal matters, filed an RTI request to the Attorney-General and Minister for Justice, Dr. Dominic Ayine to establish whether records at his office supported the allegations of Felix Ofosu-Kwakye.

The private legal practitioner sought to know when the investigations into alleged illegal mining by Akonta Mining were concluded, when the CID presented a docket to the Attorney-General, and whether the CID presented any docket on Akonta Mining to the Attorney-General between 2022 and 2024.

In a formal response to the RTI request signed by the designated information Officer of the Ministry of Justice and Office of the Attorney-General, Lydia Attoh delivered on 22 December 2025, the Attorney-General replied, denying the claims by Ofosu-Kwakye that investigations by the CID on Akonta Mining were concluded by the CID before 2025 and a docket presented to the former Attorney-General, Godfred Dame in his tenure in office.

The Office of the Attorney-General and Ministry of Justice further stated clearly that the docket was only presented to the office on 15 September 2025. The following is the verbatim reproduction of the letter from the Office of the Attorney-General and the Ministry of Justice:

“1. When did the CID complete its investigations on Akonta Mining?

ANSWER: In October, 2022, the Criminal Investigations Department (CID) of the Ghana Police Service received some petitions from Ing. Ken Ashigbey and Martin Kpebu Esq. requesting that investigations be conducted into the mining activities of Akonta Mining Co. Ltd in the Tano Nimire forest. Upon receipt of these petitions, the Ghana Police Service commenced its investigations into the alleged illegal mining activities of Akonta Mining. WE ARE, HOWEVER, UNABLE TO TELL WITH SPECIFICITY WHEN INVESTIGATIONS WERE COMPLETED.

  1. When did the CID present its docket to the Attorney-General and Ministry of Justice?

ANSWER: The CID presented its docket to this office ON OR ABOUT 15TH SEPTEMBER, 2025.

  1. Did the CID present a docket after completing its investigations on Akonta Mining to the Attorney-General between 2022 – 2024 and if so, when was it done?

ANSWER: NO, this office DID NOT RECEIVE A DOCKET IN RESPECT OF AKONTA MINING WITHIN THE STIPULATED TIME FRAME.”

The response to the RTI request has since been delivered to lawyer Jonathan Asare. With the emphatic denial of the allegations made by the Minister for Government Communications, Felix Ofosu-Kwakye, against the former Attorney-General, it remains to be seen whether the Minister will retract and apologise to Mr Godfred Yeboah Dame, or what legal remedies the former Attorney-General will have recourse to.
