The National Democratic Congress (NDC) parliamentary candidate for the 2024 general elections, Daniel Nsala Wakpal has filed an application at the Tamale High Court seeking an order to commit the Electoral Commission Chairperson, Mr Jean Mensa, for contempt of court for what he says is the failure of the chairperson to carry out the orders of the High Court issued on 24 November 2025.
According to court processes filed by lawyers for Daniel Nsala Wakpal, the applicant states that, although the EC chair was served with the court order on 25 November 2025, the EC chair has shown no sign of adhering to the said court order dated 24th November 2025.
“By the conduct of the Respondent (EC Chairperson) it is clear that she has no intention to abide by the Court’s order dated 24 November 2025.
“I am advised by Counsel and verily believe same to be true that the test for determining whether an action amounts to contempt is whether the act complained of interferes or tends to interfere with the due administration of justice.
“An act is deemed to be contemptuous when a person goes contrary to an order of a competent Court of jurisdiction.
“The EC chair’s refusal to abide by the order of the Court dated the 24 November 2025 of which the same was served on her is contemptuous of this Honourable Court,” the affidavit accompanying the application read.
Ïn the circumstances, I pray that this obvious disregard of the EC chairperson of the orders of the Court amounts to nothing more than contempt of which the [EC chairperson] ought to be convicted,” the affidavit further read.
The Tamale High Court on 24 November 2025, ordered a fresh parliamentary election in Kpandai, instructing that the rerun be held within 30 days.
Justice Emmanuel Brew Plange handed down the ruling following a petition challenging the results of the 2024 parliamentary elections in the constituency.
The case centred on alleged irregularities during voting and the collation of results, which were said to have compromised the integrity of the declared outcome.
The petition was filed by Daniel Nsala Wakpal, the former MP and NDC candidate for Kpandai, who disputed the victory of Matthew Nyindam.
Wakpal argued that the election conducted on 7 December 2024 was invalid, highlighting discrepancies in FORM 8A (Statement of Polls – Pink Sheet) for 41 out of 152 polling stations.
According to Wakpal, the election did not comply with Regulations 39 and 43 of the Public Elections Regulations, 2020 (CI 127), and the lapses materially affected the results across the affected polling stations. He sought a court order to annul the results from those 41 polling stations and to direct a rerun for them.
Justice Plange agreed with the petition, nullifying the contested results and instructing the Electoral Commission to organise a new election to determine the legitimate winner.
