Tamale High Court annuls Kpandai election, mandates fresh vote within 30 days

The Tamale High Court, led by Justice Emmanuel Brew Plange, has annulled the parliamentary election results for the Kpandai constituency and directed a fresh poll within 30 days, following a successful petition challenging the December 7, 2024, outcome.

The petition, filed by National Democratic Congress (NDC) candidate Daniel Nsala Wakpal, alleged widespread irregularities during the election. He pointed to discrepancies in Form 8A—the pink sheets—from 41 of the 152 polling stations, arguing that these violations breached Regulations 39 and 43 of the Public Elections Regulations (CI 127).

In its ruling, the court determined that the Electoral Commission’s failure to adhere to proper procedures had substantially undermined the election’s integrity. Justice Plange emphasised the need for transparency and fairness in the rerun, urging the EC to restore public confidence. “The rerun must be conducted transparently, credibly, and strictly in accordance with electoral regulations,” he said.

Matthew Nyindam of the New Patriotic Party (NPP), the incumbent MP, had originally been declared the winner of the December vote. Election day had been marred by tensions at the collation centre, with reports

of vote manipulation by NDC supporters, removal of biometric verification devices (BVRs), destruction of ballot papers, and deployment of security personnel to restore order.

The court’s directive mandates that the Electoral Commission carry out a complete rerun of the parliamentary contest across the Kpandai constituency within the stipulated 30-day period.
